Agreement to Terms

By accessing and using CampKicker, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using this service. CampKicker is operated by River Basin Holdings LLC.

Service Description

CampKicker provides AI-powered lead generation and marketing automation services, including:

• Customer profiling through StoryTelling intake
• AI-generated marketing copy via OpenAI
• Lead generation through web scraping (Apify)
• Mood-based customer matching
• Multi-channel campaign distribution
• Pay-as-you-go pricing at $0.05 per unit

User Accounts and Registration

Account Creation

• You must provide accurate and complete information during registration
• You are responsible for maintaining the security of your account credentials
• You must be at least 18 years old to use CampKicker
• You must represent a legitimate business or organization

Prohibited Uses

• Spam, harassment, or unsolicited commercial messages
• Fraudulent, misleading, or deceptive practices
• Violating any applicable laws or regulations
• Scraping or data mining our platform
• Reverse engineering or attempting to access source code
• Using leads for illegal purposes

Pricing and Payment

Pay-As-You-Go Model

• Lead generation: $0.05 per lead
• Distribution channels: $0.05 per action (email sent, message posted, etc.)
• No subscriptions or recurring fees
• You only pay for what you use

Payment Terms

• All payments processed securely through Stripe
• Payment required before campaign launch
• Prices displayed in USD
• You are responsible for all applicable taxes

Refund Policy

• Refunds available within 24 hours if leads are not delivered
• No refunds for completed campaigns that were successfully delivered
• Technical issues: Full refund if service fails to perform as described
• Partial refunds considered on a case-by-case basis

Intellectual Property

Your Content

You retain ownership of all content you provide (business information, StoryTelling responses, etc.). By using our service, you grant us a limited license to use this content to provide our services, including generating marketing copy and matching leads.

Generated Content

AI-generated marketing copy created through CampKicker is licensed to you for your business use. You may edit and customize this content. However, you may not directly copy or redistribute the raw generated content without modification.

Platform Rights

CampKicker, our logo, and all platform features are the property of River Basin Holdings LLC. You may not use our trademarks without written permission.

Lead Generation and Data Sourcing

• Leads are sourced from publicly available information via Apify web scraping
• Lead quality scores are estimates, not guarantees
• Lead accuracy depends on source data quality
• You are responsible for complying with anti-spam laws (CAN-SPAM, GDPR, CASL)
• You must obtain proper consent before contacting leads
• We are not responsible for how you use the generated leads

Service Availability

• We strive for 99.9% uptime but do not guarantee uninterrupted service
• Scheduled maintenance will be announced in advance when possible
• Third-party service outages (OpenAI, Apify, Stripe) may affect availability
• We reserve the right to modify or discontinue features with notice

Limitations of Liability

To the maximum extent permitted by law:

• CampKicker is provided "as is" without warranties of any kind
• We are not liable for indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid in the last 3 months
• We are not responsible for third-party service failures or data accuracy
• You assume all risk for campaign outcomes and lead quality

Compliance and Legal Use

You agree to use CampKicker in compliance with all applicable laws, including:

• CAN-SPAM Act: Include opt-out mechanisms in emails
• GDPR: Obtain consent for EU contacts
• CASL: Follow Canadian anti-spam requirements
• TCPA: Comply with telephone consumer protection laws
• State Privacy Laws: CCPA, VCDPA, and other state regulations

Violation of these laws may result in immediate account termination.

Termination

We reserve the right to suspend or terminate your account if:

• You violate these Terms of Service
• You engage in fraudulent or illegal activity
• Payment fails or chargebacks are filed
• You abuse the platform or generate excessive support requests

You may terminate your account at any time by contacting support. Upon termination, you will lose access to all data and generated content.

Dispute Resolution

Any disputes arising from these Terms or your use of CampKicker shall be:

• Governed by the laws of the State of Iowa, United States
• Resolved through binding arbitration (excluding small claims court)
• Subject to the jurisdiction of courts in Davenport, Iowa

Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email. Your continued use of CampKicker after changes constitutes acceptance of the modified Terms.

Indemnification

You agree to indemnify and hold harmless River Basin Holdings LLC from any claims, damages, or expenses arising from your use of CampKicker, including your use of generated leads and marketing copy, or your violation of these Terms.

Data Usage and AI Training

By using CampKicker:

• Your StoryTelling responses may be used to improve our mood matching algorithms
• Campaign performance data may be aggregated (anonymized) for analytics
• We do not share your specific business information with competitors
• OpenAI's data usage policy applies to generated content

Service Level Agreement (SLA)

While we strive for high availability, we make no guarantees regarding:

• Lead generation speed (dependent on Apify)
• Number of leads returned (varies by search parameters)
• AI copy quality (subjective and dependent on input quality)
• Campaign conversion rates or business outcomes

Third-Party Services

CampKicker integrates with third-party services. You acknowledge that:

• These services have their own terms of service
• We are not responsible for third-party service outages or changes
• Pricing may be adjusted if third-party costs increase
• Data shared with these services is subject to their privacy policies

Acceptable Use of Generated Content

Marketing copy generated by CampKicker:

• Is licensed for your business use only
• Should be reviewed and edited before use
• May not be resold or redistributed to third parties
• Must comply with advertising standards and regulations
• You are responsible for ensuring accuracy and compliance

Data Retention and Deletion

• Campaign data retained for 90 days after completion
• Account data retained until you request deletion
• Analytics data may be retained indefinitely in anonymized form
• You may request full data deletion by contacting support

Beta Features and Changes

CampKicker may include beta features or experimental functionality. These features are provided "as is" and may be modified or removed without notice. We reserve the right to add, modify, or remove features as we improve the platform.
